Signature in Lieu of Filing Fees; Partisan and Independent State Constitutional Insurance Commissioner and Legislative Candidates

During this period, a partisan or independent candidate for any statewide constitutional or legislative seat may obtain his or her forms from the county elections official or the Secretary of State for circulation petitions to secure signatures in lieu of all or part of the filing fee. Petition signatures must be filed with elections official of the county in which they were gathered.

Declaration of Intention and Filing Fee Payments- Partisan and Independent State Constitutional, Insurance Commissioner, or Legislative Candidates

During this period, each partisan and independent candidate for a state constitutional, Insurance Commissioner, or legislative seat shall file a Declaration of Intention and pay the appropriate filing fee in the office of either the Secretary of State of the county elections official of the county in which the candidate is a resident. Independent candidates for offices that require the filing of a Declaration of Intention must file a Declaration during this period. If this declaration is filed with the Secretary of the State, the entire nonrefundable filing fee must be pain by cash, check or money order. The secretary of state cannot accept signatures-in-lieu.

Declaration of Intention - Extension Period for Partisan and Independent State Constitutional, Insurance Commissioner, and Legislative Candidates

If the incumbent State Constitutional, Insurance Commissioner, or legislative candidate for the office has not filed a Declaration of Intention to succeed to the same office, then any person, other than then incumbent, may file such a declaration during the extension period. If failure to file a Declaration of Intention is because the incumbent has already served the maximum number of terms, there shall be no extension of the period for filing a Declaration of Intention.

Nomination Period Extension for Candidates for State Constitutional, Insurance Commissioner, and Legislative Offices

If an eligible incumbent State Constitutional, Insurance Commissioner, or legislator files a Declaration of Intention but for any reason fails to qualify for the nomination by Dec. 7, a five-day extension is allowed for any qualified person other than the incumbent to file for such office during the extension period not with standing that he or she has not filed a written and signed Declaration of Intention to become a candidate for then office.
